A Verizon Inc. disability plan’s attempt to claw back $44,962 in payments made to an employee who was injured in a car accident can’t be resolved without a trial, a Rhode Island federal court ruled.
The dispute turns on whether the Verizon plan has the authority to recoup its disability payments from a $100,000 personal injury settlement held by the employee’s lawyer. The plan’s summary document includes “crystal-clear” language authorizing the plan to recoup payments made to a participant who later receives a third-party recovery, but it’s not clear whether the plan can recover this money from a law firm …
